LES MILLS WORKOUTS

In addition to your live and Virtual timetables, live-streaming is a great way to establish and maintain a strong connection with your members, especially during these post-pandemic times. The great news is, using cover/PPCA-free music (which your Instructors automatically have access to, via their online Instructor portal), you can now live-stream your regular Les Mills workouts to your members using your Club’s closed platforms like Zoom or a member-only app. This means, once your club has acquired the appropriate music licenses (i.e., to broadcast using cover/license-free music), then your Instructors can do so to your members via those closed platforms. Reminder: Les Mills programs that do not have cover music available (i.e, LES MILLS BARRE®, BODYJAM® and LES MILLS TONE®) are unable to be live-streamed at this point in time. We will keep you posted with any updates on this.

LES MILLS+ AFFILIATE PROGRAM

Live-streaming is a great way to keep the connection alive with your members, but if it becomes temporarily unavailable for any reason, here’s a great alternative – which can also serve as a valuable profit centre during challenging times.

LES MILLS+ enables your members to stay active through at-home participation in their favourite Les Mills classes. The LES MILLS+ Affiliate Program means you can generate revenue every time your members sign up. The great news is, research from Alliance Leisure found 96 per cent of consumers who tried a workout from a Club during lockdown, said they would consider using that same facility when it reopened.

LIVE-STREAMING TERMS & CONDITIONS

Facilities currently licensed to use LES MILLS Programs (Licensed Facilities) and their qualified Les Mills Instructors (Instructors) are granted a limited and revocable right to live-stream classes of LES MILLS Programs subject to and in accordance with, the following terms and conditions:

  1. Instructors may only live-stream classes of LES MILLS Programs, (i) that they are qualified to teach in a live class; and (ii) on behalf of a Licensed Facility.
  2. Licensed Facilities may only live-stream classes of LES MILLS Programs, (i) that are licensed at their location; (ii) using qualified LES MILLS instructors; and (iii) to physical members of their location whose membership gives them the right to attend classes being live-streamed, either behind a login or within a private group. Live-stream classes must not be broadcast to the general public.
  3. Licensed Facilities must NOT record live-streamed classes, or make them available for playback at any time after the live-stream.
  4. To the extent required, Licensed Facilities will be responsible for securing and paying for music licenses from the relevant collection society, performing right organisation or other entity in respect of their live-streamed classes.
  5. Licensed Facilities will be responsible for complying with the terms of use and paying fees for (if applicable) the live-stream platform they have chosen to use.
  6. Licensed Facilities will ensure the appropriate insurance is in place to cover live-streaming (including any physical injury to participants).
  7. Licensed Facilities and Instructors will be responsible for compliance with any applicable laws and regulations that might apply to the live-stream classes.
  8. The live-stream fees will be subject to all other provisions of the Licence, including the CPI escalator.
  9. The right to live-stream classes is an extension of the existing agreements with Licensed Facilities and Instructors. The terms and conditions that apply to Programs and classes in such existing agreements will also apply to live-stream classes (unless the context requires otherwise).
  10. Les Mills may withdraw the right to live-stream LES MILLS Programs (or certain LES MILLS Programs) at any time without notice.
  11. Live-streaming may only be done using cover/PPCA-free music. Live-streaming is not permitted using original music.

For live-streaming, are any changes required to my Club Agreement with Les Mills Asia Pacific?

Yes, the current Club Agreement does not cover the provision to live-stream Les Mills workouts. If you would like to live-stream Les Mills classes, please reach out to your local business partnership manager in Australia or South East Asia for full details, including information about the required music licenses.

Can I live-stream all Les Mills workouts, or only ones I have a program license for?

The rules around live-streaming are the similar as for your live workout, which means you may only live-stream those programs that you have a license for; and you must use an active Les Mills Instructor who is certified to teach that program.

Can we live-stream via Facebook or Instagram?

A live-stream class may only be broadcast to your members through a closed/private streaming platform, such as Zoom or via a members-only web portal or app. This ensures that your live-stream workouts only target current members or participants who pay for access on a casual basis. To discuss the option of live-streaming to non-paying participants for member acquisition purposes (in the same way you would for a Club Open Day), reach out to your local Business Partnership Manager in Australia or South East Asia.

Can we charge our members extra for the live-stream classes?

This is entirely up to you. If your Club is closed and members are currently not paying, you could create an ‘at-home’ membership, or offer these classes on a pay-per-view basis using the closed platform of your choice (e.g., Zoom).

Can we save or record our live-stream classes to make them available on-demand for people who can’t attend the class time?

No, your Club’s live-stream music license will not permit any live-streamed classes to be recorded, saved or replayed, under in any circumstances.

Will live-streaming mean there’ll be an extra fee charged, on top of our existing program license fees?

When streaming a live workout, can I have participants in my class?

Yes, you can live-stream whilst teaching a class; however, you will need to make sure your participants sign a waiver to give you permission to do so, or ensure they are off camera and do not appear in your live-stream footage.
 

Do I have to be certified in the program to teach a live-stream workout?

Yes. As with live classes, you are only permitted to teach the Les Mills programs that you are certified in.

Why do I have to live-stream through a Club?

Live-streaming may only be done on behalf of a licensed Club. This is due to the music rights that the Club has purchased because, remember, it’s the facility who has the license to broadcast the music.

Can I live-stream on my own if I no longer work for a Club?

No, you can’t. As with live classes, any live-streamed Les Mills workouts need to be done with a licensed Club and should only be done for the specific programs that the Club has licenses for, and in which you are certified to teach.

Will I be able to access cover music for my previously purchased Back Releases?

Cover music files are available for free downloading in your Instructor Portal, for most programs that you’ve purchased as of Q1.2020 or later.

Will Les Mills provide additional Les Mills original/royalty-free music so we can continue to live-stream on our own?

No. The Les Mills original/royalty-free music was a short-term solution to help keep Clubs and Instructors connected to their members during the first waves of lockdown. Although these Releases were good, they were put together quickly and are not the same premium quality as our standard Releases. In contrast, this long-term live-streaming solution enables you to bring back your Instructors so they can teach for the Club in some capacity.

Does my current certification allow me to live-stream, or is there any additional education requirement?

Similar to teaching a live workout, you can live-stream on a closed platform, for a licensed Club in the programs you are certified in. There is no additional education requirement to deliver live-stream workouts. For helpful tips to ensure a positive live-stream experience for your members, click here.

Does Les Mills Asia Pacific encourage Clubs to live-stream?

Yes, as we believe live-streaming is a great way to help support member engagement. As such, our Business Partnership Managers will be discussing this with all our Club Partners.

Could I teach live-streaming for another Club not in my area?

Yes, you can - so long as the Club has a current license. Just remember, often the beauty of live-streaming is that the members who already know and love you, can reconnect with you while they can’t attend in-person.
 

Who should a Club contact to get a live-stream music license?

Each Club is responsible for obtaining the necessary licenses to live-stream classes in their country/area. Therefore, to find out about the licenses required for live-streaming, Clubs should get in touch with the local music licensing authority or Performing Rights Organisation (PRO) who represents the songwriters/publishers in their country. Clubs will typically already have a license from their PRO for the use of music in live/Virtual classes in their Clubs, so they’ll be familiar with this process.

How do I know if I need to use cover music for my live-streams?

You will need to speak to your Club about this. Cover music (called “PPCA-free music” in Australia) is available to Instructors/Clubs for the purpose of live-streaming. Les Mills cannot authorise the use of original artist recordings in live-streaming. In some countries, the local music licensing authority or performing rights organisation for sound recording rights, may be able to provide a licenses for a Club to use original artist recordings; however, each Club needs to make their own enquiries to find out if this is possible in their individual situation.

Why do Clubs need to get additional music licenses?

Clubs are required to have a license from the local music licensing authority or Performing Rights Organisation (PRO) in order to play music during live or Virtual classes. An additional license is typically required from these organisations, to enable Clubs to deliver live-streamed classes.

My program doesn’t have cover music available. Does this mean I can’t live-stream?

If your Club’s live-streaming music license requires you to use cover music then, unfortunately, you will not be able to teach a program that does not have cover music available.
